Subrogation Commerical Litigation Professional Liability Insurance Coverage and Defense Employment Practice SUBROGATION A significant percentage of the cases we handle involve subrogation and loss recovery. Our subrogation attorneys have one goal: to increase the amount of subrogation recovery dollars for our clients. We have recovered millions of dollars for numerous large and small insurance carriers and self-insureds. Our primary focus is property losses arising from fire, explosion, construction, product defects, transportation and natural disasters. We prosecute cases in federal and state courts throughout the United States. Subrogation Programs and Services We are proud to have national and regional subrogation recovery programs with several major insurance carriers. The programs allow us to provide our clients with early and accurate investigation and analysis of losses, including the retention and direction of experts, on-site examinations, retention of evidence and notification of potential defendants. However, in additions to our recovery programs, we provide representation on a "case-by-case" basis and review older files to determine if claims that were previously closed have subrogation potential. We also can assist you in implementing subrogation programs within your company and provide the necessary training for a successful program. In fact, our attorneys are frequently called upon to give seminars in varying technical and legal aspects of the subrogation process to improve a company's overall recovery effort. Prompt Investigation We strongly believe that a case can be won or lost in the hours after a loss occurs. Therefore, prompt recognition of, and action on subrogation potential are tantamount to maximizing your recovery dollars. To this end, we are available 24 hours a day, seven days a week, to provide immediate investigations and coordination of experts, especially on catastrophic losses. We also maintain a complete database of cause and origin and forensic experts. Many of these experts we have either used in the past or have been adverse to our clients so we are aware of their skills, abilities and specialties. Flexible Fees and Cost Structures Our Firm offers subrogation clients flexible fee structures including contingent, hourly and mixed hourly/contingent fees. We also do not charge our subrogation clients for "operational costs" that the majority of other subrogation firms charge. These include telephone, normal copying, and messenger/delivery charges. And for the expenses that are necessary for a case, such as travel, consultants, depositions, etc., we do our best to use the best quality and cheapest alternatives for our clients. The Firm has successfully handled numerous commercial litigation cases representing these clients in the formation and breach of contracts, Uniform Commercial Code disputes and breach of warranties. The Firm's attorneys actively represent clients as both plaintiffs and defendants in a broad range of business torts including: tortious interference with contractual relationships, unfair competition claims, misappropriation of trade secretes and other confidential information, trade libel, intentional interference with prospective business advantage and fraud. A notable example of the Firm's achievements and success in commercial litigation includes the successful defense and award of a million dollar counter-claim verdict in a week long arbitration in New York of an international commercial dispute. Our firm represented a South American company that defeated a $6,000,000.00 claim against it by a United States company and won $1,000,000.00 on a counter-claim before three arbitrators from three different countries.
